JUVENILE CURFEW

Section 1:  This ordinance shall be known as cited as the "Unadilla Curfew Ordinance."

Section 2:  No minor under the age of twelve (12) years shall loiter, idle, or congregate in or on any public street, highway, alley, or park located within the Township between the hours of 10:00 P.M. and 6:00 A.M., unless the minor is accompanied by a parent or guardian, or an adult delegated by the parent or guardian to accompany the child.

Section 3:  A minor under the age of sixteen (16) years shall not loiter, idle or congregate in or on any public street, highway, alley or park located within the Township between the hours of 10:00 P.M. and 6:00 A.M., immediately following, except where the minor is accompanied by a parent or guardian, or an adult delegated by the parent or guardian to accompany the minor, or where the minor is upon an errand or other legitimate business directed by his/her parent or guardian.

Section 4:  Any person of the age of sixteen (16) years or over assisting, aiding, abetting, allowing, permitting or encouraging any minor under the age of sixteen (16) years to violate the provisions of Sections 1 and 2 hereof is guilty of a misdemeanor, punishable by up to ninety (90) days in jail and/or $500 in fine, plus costs of Court.

Section 5:  Any person under the age of sixteen (16) years who violates Sections 1 and 2, above, shall be subject to the jurisdiction of the Livingston County Juvenile Court and shall be subject to any and all disposition that Court may, in its discretion, impose upon said minor.

Section 6:  All Ordinances inconsistent herewith are repealed.

Section 7:  This Ordinance shall be enforced by the Township Ordinance Enforcement Officer or such person as may, from time to time be appointed by the Township Board.

Section 8:  This Ordinance is necessary for the preservation of the public health, safety and welfare and shall be effective immediately upon publication as provided by law.
